These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and ScendGrow ("we," "us" or "our"), concerning your access to and use of the scendgrow.com website and application.

2. User Representations (The "Don't Spam" Clause)

By using the Site, you represent and warrant that: You will not use the platform to send unsolicited bulk SMS or Email (Spam) in violation of the CAN-SPAM Act or TCPA. You have obtained necessary consent from your contacts before uploading them to ScendGrow. Liability: ScendGrow is a software tool. We are not responsible for your compliance with local marketing laws. You assume full responsibility for the messages you send.

3. Billing and Cancellation

Subscriptions: ScendGrow is billed on a month-to-month basis. Cancellation: You may cancel your subscription at any time via the billing portal inside the app or by emailing support. Refunds: We offer a 14-Day "Revenue First" Money-Back Guarantee. If you are not satisfied within the first 14 days of your initial subscription, you may request a full refund. After 14 days, no refunds will be issued for partial months.

4. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site.
